Article 1 – Definitions
In these General Terms and Conditions, the following definitions apply:
UniqueSwimwear: the company UniqueSwimwear, established in Amsterdam, The Netherlands.
Customer: any natural person or legal entity entering into an agreement with UniqueSwimwear.
Consumer: a natural person acting for purposes outside their trade, business or profession.
Agreement: any agreement concluded between UniqueSwimwear and the Customer.
Products: all products offered by UniqueSwimwear through its webshop or any other sales channel.
Website: www.uniqueswimwear.nl.
Article 2 – Applicability
These General Terms and Conditions apply to all offers, quotations, orders, agreements and deliveries made by or on behalf of UniqueSwimwear.
Any deviations from these Terms are only valid if agreed in writing.
The applicability of the Customer's own general terms and conditions is expressly excluded unless agreed otherwise in writing.
If one or more provisions of these Terms are declared invalid or unenforceable, the remaining provisions shall remain fully effective.
Article 3 – Offers and Orders
All offers made by UniqueSwimwear are without obligation unless expressly stated otherwise.
UniqueSwimwear reserves the right to refuse or cancel an order in cases including but not limited to:
- suspected fraud;
- incorrect pricing due to technical or human error;
- incorrect stock availability;
- payment problems;
- suspected misuse of promotions or discount codes.
An agreement is concluded only after the Customer receives an order confirmation by email.
Obvious pricing errors or typographical mistakes do not bind UniqueSwimwear.
Article 4 – Prices
All prices displayed on the Website are in Euros (€) and include VAT where applicable, unless stated otherwise.
Shipping costs, import duties or additional charges are shown separately during checkout where applicable.
UniqueSwimwear reserves the right to change prices at any time before an Agreement is concluded.
Price increases resulting from changes in taxes, legislation or circumstances beyond the reasonable control of UniqueSwimwear may be implemented.
Consumers have the rights granted under mandatory Dutch consumer law regarding price changes after an Agreement has been concluded.
Article 5 – Payment
Payment methods offered on the Website are shown during checkout.
UniqueSwimwear may require full payment before dispatch of the Products.
If payment is not received within the agreed payment period, the Customer will be considered in default after the legally required reminder period where applicable.
For Consumers, statutory interest and statutory collection costs under Dutch law shall apply.
For business Customers, statutory commercial interest may be charged.
All collection costs reasonably incurred due to late payment shall be borne by the Customer insofar as permitted by law.
UniqueSwimwear reserves the right to suspend deliveries until payment has been received in full.
Article 6 – Delivery
UniqueSwimwear aims to dispatch orders as quickly as reasonably possible.
Delivery times stated on the Website are estimates and do not constitute strict deadlines unless expressly agreed otherwise.
Delayed delivery does not automatically entitle the Customer to compensation.
If delivery is substantially delayed, the Customer may exercise the rights granted under applicable law.
Delivery takes place at the address provided by the Customer.
The Customer is responsible for providing a correct delivery address.
Any additional costs resulting from incorrect address information supplied by the Customer may be charged to the Customer.
Article 7 – Risk and Retention of Title
Ownership of all Products remains with UniqueSwimwear until full payment has been received.
The risk of loss or damage transfers to the Consumer when the Products are delivered to the Consumer or a third party designated by the Consumer.
For business Customers, risk transfers upon delivery to the carrier unless mandatory law provides otherwise.
Article 8 – Right of Withdrawal
Consumers purchasing Products online have the statutory right to withdraw from the Agreement within fourteen (14) days without giving any reason.
The withdrawal period starts on the day after the Consumer, or a third party designated by the Consumer, receives the Product.
To exercise the right of withdrawal, the Consumer must notify UniqueSwimwear by email at:

The Consumer must return the Products within fourteen (14) days after notifying UniqueSwimwear.
Returned Products must:
- be unworn;
- be unwashed;
- be undamaged;
- include all original tags;
- be returned in the original packaging where reasonably possible.
The Consumer may inspect and try on the Product only to the extent necessary to determine its nature, characteristics and fit, as would be permitted in a physical store.
Where a Product has been used beyond what is necessary for such inspection, UniqueSwimwear may reduce the refund to reflect the diminished value.
Article 9 – Hygiene Products
For reasons of health protection and hygiene, swimwear can only be returned if:
- the hygiene liner or hygiene seal has not been removed or damaged;
- the Product has not been worn other than for fitting;
- the Product is returned in resalable condition.
If the hygiene seal has been broken after delivery, the statutory right of withdrawal may no longer apply where permitted under applicable consumer legislation.
Article 10 – Refunds
Following a valid withdrawal, UniqueSwimwear will refund all payments received for the returned Products, including the standard delivery costs where required by law.
Refunds will be processed within fourteen (14) days after receiving the returned Products or proof of shipment, whichever occurs first.
Refunds will be made using the same payment method originally used by the Consumer unless otherwise agreed.
Unless otherwise agreed, the direct costs of returning Products are borne by the Consumer.
Article 11 – Exchanges
Products may be exchanged within fourteen (14) days after delivery provided that:
- the Product is unused;
- the hygiene liner remains intact;
- all original labels are attached;
- the Product is returned in its original condition.
Custom-made Products, personalised Products, gift cards and Products excluded by law cannot be exchanged.
Article 12 – Warranty
Consumers are entitled to the statutory legal guarantee under Dutch law.
This means that Products must conform to the Agreement and possess the qualities that Consumers may reasonably expect.
The warranty does not cover:
- normal wear and tear;
- accidental damage;
- improper use;
- incorrect washing or care;
- alterations made by the Customer;
- damage caused by negligence.
If a Product is defective upon delivery, the Customer should contact UniqueSwimwear as soon as reasonably possible.
Article 13 – Complaints
The Customer must inspect the Products upon receipt and notify UniqueSwimwear of any defects within a reasonable period after discovery.
Consumers must report defects within two (2) months after discovering the defect, as required under Dutch consumer law.
A complaint must include:
- the order number;
- a description of the issue;
- photographs or other supporting information where applicable.
UniqueSwimwear will review complaints within a reasonable period and will provide an appropriate response.
Submitting a complaint does not suspend the Customer’s payment obligations unless otherwise required by law.
Article 14 – Liability
UniqueSwimwear is only liable for direct damages caused by an attributable failure in the performance of an Agreement, where such liability cannot be excluded under mandatory law.
UniqueSwimwear is not liable for indirect damages, including but not limited to:
- loss of profit;
- loss of business opportunities;
- consequential damages;
- loss of data;
- damages suffered by third parties.
The limitations of liability in these Terms do not apply where liability cannot legally be limited, including cases of intent or gross negligence.
Images, colours, sizes and descriptions displayed on the Website are intended to provide an accurate impression of the Products. Minor differences in colour or appearance may occur due to screen settings or manufacturing variations and do not automatically constitute a defect.
Article 15 – Intellectual Property
All intellectual property rights relating to the Website, including but not limited to:
- photographs;
- logos;
- designs;
- texts;
- product descriptions;
- graphics;
- branding materials;
remain the property of UniqueSwimwear or its licensors.
The Customer may not copy, reproduce, distribute or use any content from the Website without prior written permission from UniqueSwimwear.
Article 16 – Privacy and Personal Data
UniqueSwimwear processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch privacy legislation.
Personal data may be used for purposes including:
- processing orders;
- delivering Products;
- customer service;
- payment processing;
- improving Website services.
Further information about the processing of personal data can be found in the Privacy Policy available on the Website.
Article 17 – Force Majeure
UniqueSwimwear is not liable for delays or failures in performing its obligations if such delay or failure results from circumstances beyond its reasonable control.
Force majeure may include, but is not limited to:
- natural disasters;
- government measures;
- strikes;
- supply chain disruptions;
- supplier failures;
- transport problems;
- internet or technical failures;
- cyber incidents;
- pandemics or public emergencies.
During a force majeure situation, UniqueSwimwear’s obligations may be suspended.
If a force majeure situation continues for more than thirty (30) days, either party may terminate the Agreement in writing where permitted by law.
Article 18 – Suspension and Termination
UniqueSwimwear has the right to suspend performance or terminate an Agreement if:
- the Customer fails to meet payment obligations;
- the Customer provides incorrect information;
- circumstances arise that give UniqueSwimwear reasonable grounds to believe that obligations will not be fulfilled.
Consumers retain all rights provided under mandatory consumer protection laws.
Article 19 – Amendments to These Terms
UniqueSwimwear reserves the right to amend these General Terms and Conditions.
Changes of a minor nature may be implemented at any time.
Significant changes affecting existing Customers will be communicated where required by law.
The applicable version of the Terms is the version valid at the time the Agreement is concluded.
Article 20 – Transfer of Rights
The Customer may not transfer rights or obligations arising from an Agreement to a third party without the prior written consent of UniqueSwimwear, unless mandatory law provides otherwise.
Article 21 – Severability
If any provision of these General Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in full force.
The invalid provision will be replaced by a valid provision that most closely reflects the original intention of the parties.
Article 22 – Applicable Law and Jurisdiction
All agreements between UniqueSwimwear and the Customer are governed exclusively by Dutch law.
Any disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer protection law provides otherwise.
Consumers may also use available alternative dispute resolution procedures where applicable.
